Sono molti gli edifici condominiali che posseggono cortili o aree aperte che potrebbero essere destinate a parcheggio ma se il regolamento di condominio non disciplina l’uso di tali aree, ponendo limiti o divieti all’occupazione degli spazi, non resta che ancorarsi all’articolo 1102 del Codice Civile che disciplina l’uso della cosa comune.
Il parcheggio, quindi, deve rimanere temporaneo. Altrimenti, rilevano ancora i giudici, «la condotta del singolo condomino, che parcheggia per lunghi periodi di tempo la sua autovettura nel cortile condominiale, manifesta l’intenzione di possedere il bene in maniera esclusiva ed è tale da configurarsi come occupazione stabile, abusiva, in quanto impedisce agli altri condomini di partecipare all’utilizzo dello spazio comune», (Cassazione, sentenza 3640/2004) quindi non è consentito.
